Conditions of Participation for raffles and prize draws

USECON – The Usability Consultants GmbH (referred to as „USECON“), offers occasionally online raffles and prize draws. The participation in raffles and prize draws shall be based on our participation conditions.

Data protection

With the participation in raffles and prize draws the participant explicitly consents, that USECON is permitted to store the necessary data for the period of the raffle/prize draw and beyond.  Participants may at any time withdraw the permission and thereby withdraw from participation. Collected data will be used for market research by USECON and her partner organisation CURE. USECON points out that all personal data will not be made available to third parties. The winners shall consent to publication of their names and place of domicile.

Participation / Prize draw

The raffles/prize draws will be carried out depending on the action either autonomously or in cooperation with partners. The prize draw only takes place within Austria. For the draw only participants will be considered, who have registered (during the runtime of the raffles/prize draws) on https://www.usecon.com (or in the indicated respective form for the raffle/prize draw) and entered their data completely, true and correct. Among all participants/registrations the lot decides ensuring random principle. One participant may be awarded one prize only. Cash payment or a transfer of the winnings is not possible. In case the handover is not possible or unacceptable, the winner will receive an equivalent replacement.

The winners will be informed in writing by USECON. In case the winner fails to answer the notice within 21 days, the claim to the prize expires and according to the same procedure a substitute winner will be drawn. The participant is responsible for the correctness of the submitted address. The announcement of the winners shall be without guarantee.

Participants, disqualification form raffle or prize draw

The registration on https://www.usecon.com  (or in the respective specified form for the raffle/prize draw) under 18 years of age is only possible with parental consent. The participation is only possible with the consent from parents or a legal guardian. For the participation in the raffle/prize draw it is absolutely required that all personal data is true and correct. Employees of USECON and affiliated companies as well as raffle partners including relatives of the aforementioned groups are excluded from participation. USECON reserves the right to exclude persons from participation if there are justifying reasons, e.g. breach of the conditions of participation, double participation, undue influence on the raffle, manipulation, etc. In such cases winnings can subsequently be revoked or reclaimed.

Modification of the terms and conditions of participation of the raffle

USECON reserves the right to modify the conditions of participation at any time. Furthermore USECON reserves the right to terminate or interrupt without preannouncement the raffle or prize draw at any time. This applies in particular for reasons that disrupts or prevents the scheduled course of the raffle or prize draw. Provided that such a termination caused by the conduct of a participant USECON is entitled to demand compensation for the damage caused by this person.

Liability imitations  

SECON can only be held liable if the damage was caused by breach of a significant contractual obligation (cardinal obligation) in a manner that endangers the achievement of the purpose of the contract or have acted grossly negligently or with intent. If USECON is liable under the previous paragraph for the breach of a significant contractual obligation without any occurrence of intent or gross negligence, the liability is limited to typically foreseeable damage, the occurrence of which we should have anticipated in accordance with the circumstances known to us upon conclusion of contract.

The afore-mentioned limitations of liability shall not apply to culpable injury to life, limb and health and for personal damage, for damages according to the product liability law or in case of a contractually agreed obligation to assume liability irrespective of any fault as well as the causal circumstances for liability have maliciously been concealed.

As far as the liability of USECON according to the regulations of this disclaimer is excluded or limited this is also valid for the personal liability of executive bodies, employees, representatives and vicarious agents.

Other

Should any of the individual provisions in these conditions of entry prove invalid or become invalid, the remaining parts shall remain unaffected in their content and validity. The invalid part will be replaced by an appropriate arrangement that comes as close as possible to this provision.

For our raffles/prize draws any recourse to courts of law is excluded.

General Terms and Conditions for the subscription to a Newsletter of USECON – The Usability Consultants GmbH

1. Scope of Application

1.1
The general terms and conditions hereinafter (referred to as “GTC”) apply to the subscription to a newsletter of USECON – The Usability Consultants GmbH (referred to as “USECON”). USECON offers interested persons the possibility to register for the subscription to the newsletter by filling in the respective form provided at the USECON website.
1.2
The participant acknowledges the GTC by submitting this registration.
1.3
The participant may access, print as well as download or store these GTC with the link provided by websites operated by USECON.
1.4

2. Liability

2.1
USECON shall not be liable for false information which are provoked and disseminated by participants and/or third parties, including cooperation partners of USECON and which are related to the distribution of information about the newsletter. In particular USECON assumes no guarantee, if emails or data entries (e.g. in online application forms of the newsletters) not comply with technical requirements set out with the GTC or defined by the website and as a result will not be accepted by the system.
2.2
USECON cannot be held liable for offers of third parties, especially not for those of cooperation partners of USECON, who are or have been promoted in the newsletter. USECON will assume no guarantee that all links and references which are converted to external content are accurate and complete.
2.3
USECON will assume no guarantee that the newsletter service or the respective newsletter-website is available for interested persons at anytime and flawless in respect to content or technical aspects.
2.4
USECON reserves the right to prematurely and without further notice to subscribers terminate the newsletter service, if a secure and frictionless organisation of this service can no longer be guaranteed due to external influences or technical problems.

3. Promotional Activities, Consent

3.1
The participant may revoke this consent at anytime by email (to office@usecon.com) or by post (mailing address as indicated in 1.4).

4. Data Protection, Right of Cancellation

4.1
USECON stores the data up to the end of the third year of the last contact with the client, as required and permitted by law.
4.2
In the collection, processing and utilisation of personal data of participants USECON will observe the applicable data protection law. The participant may revoke at anytime his consent to the storage and utilisation of his data by email (to office@usecon.com) or by post (mailing address as indicated in 1.4). With the deletion of the data the subscription to the newsletter is excluded.

5. Final Provisions

5.1
Modifications to these GTC shall require the written form to become effective. The same applies to any waiver of the written form.
5.2
If individual provisions of these GTC are invalid and/or unenforceable the validation of the rest of the provisions remain unaffected.
5.3
Place of performance and jurisdiction is Wels, where an agreement regarding this is legally admissible. USECON reserves the right to take legal action against a participant at his place of residence as well as before any competent court in Austria and abroad.
